Losing a loved one is one of the most difficult experiences in life.  Losing a loved one in an accident that could have been prevented can be even more devastating.  Those who have lost family members as the result of another’s negligence, carelessness, or wrongful death may have the right to make a legal claim so the at-fault person is held responsible. These lawsuits, or wrongful death claims, may also allow certain eligible family members to recover money for damages resulting from their loved one’s death.

Missouri’s wrongful death law, § 537.080 of the Missouri Revised Statutes, establishes who can file a wrongful death claim. Accord to this law, certain family members may file wrongful death lawsuits in situations where their loved one’s death was wrongfully caused by another, specifically when a victim would have been entitled to money had he or she lived.

The law states that the following family members have a right to file wrongful death claims:

·         Spouses

·         Children

·         Siblings

·         A family’s representative

When determining money damages in a wrongful death case, generally, the court must look at money that is lost. The court may consider other types of loss, such as emotional loss; however, the loss must be one that can be calculated in order for the family member to be paid.  Some financial expenses of your deceased loved one that the court will consider are the annual wages, the financial dependence of the family members on the deceased, the amount of the deceased’s savings, any other assets, medical costs and funeral costs.  When looking at the deceased’s finances, the court will also consider things such as the deceased’s life expectancy (including overall heath), earning potential and the loss of household duties (including house care, child care and/or caring for other family member’s financial or living needs).  In some cases, if the deceased was in school to prepare for a career, the court may take that loss of future career and increase in earning potential into consideration as well.

Mr. Campbell, a wrongful death attorney with four decades of legal experience, will work with teams of experts and specialists to build a case using the latest technology and available data on accident causes and effects.  He knows how to confidently prepare and present wrongful death cases that effectively convince juries to give you money to justly pay you for the loss of your loved one.
