As you know, the courts encourage mediation of disputes in civil cases for three reasons: the court system doesn’t have the resources to have a trial in every civil lawsuit; often the parties reach a better result in mediation; and people are often more satisfied with a mediated resolution.

If your mediation is successful, the client’s cost of resolving the dispute will be substantially less than if the lawsuit goes to trial.  Mr. Campbell will charge by the hour.  Many cases are mediated and resolved in only a few hours. 

When you retain Mr. Campbell, he will ask each party to provide him information about the case before the mediation session to help him to prepare.

The mediation process is flexible.  Mr. Campbell will have an initial session with all the parties and their attorneys.  Sometimes the mediation will continue with all of the parties together.  Other times, Mr. Campbell or the parties may prefer to have him meet with each side confidentially, going back and forth between the parties until an agreement is reached.

Mr. Campbell will act as an Evaluative mediator. He will intervene in the mediation by making recommendations or providing opinions as to what might occur should your case go back to court.  Mr. Campbell will use his extensive experience and expertise in the substance of the dispute and he will apply his knowledge to offer an opinion of the merits of the case.  Mr. Campbell’s evaluation can either apply to the legal issues or factual issues, be they medical, engineering, financial or otherwise.  Mr. Campbell will point out the strengths and/or weaknesses of each parties’ position. 

Mr. Campbell will give evaluations in your case in private “caucuses” rather than the parties’ joint sessions.  A “caucus” is a separate session between him as the mediator and each party to the dispute, outside of the presence of all other parties.  A “caucus” session with a party will include the party's lawyer, unless the party instructs otherwise.  Through “caucus”, Mr. Campbell will explore privately with the party such matters as impediments to settlement and the consequences of various alternatives.

The mediation will conclude with Mr. Campbell drafting a basic writing of the agreement reached during the mediation.  Each party will sign the agreement and one of the attorneys will agree to draft a formal settlement agreement and other documents necessary for court conclusion.
